Abstract (en)

This article, doctoral research breakthrough, analyzes the problem of the effective
realization of rights, particularly with regards to the actual recognition and awarding
thereof in their respective subjects, by court orders. This aspect represents a relevant
problem in philosophy and legal theory of our time, specifically in the effective
protection of human rights.

Resumen: El presente artículo y avance de investigación doctoral, analiza la problemáticade la realización efectiva de los derechos, concretamente en lo que se refiere alreconocimiento y adjudicación real de estos en sus respectivos sujetos, mediantelas providencias judiciales. Este aspecto representa un problema relevante en lafilosofía y la teoría del derecho de nuestro tiempo, concretamente en la protecciónefectiva de los derechos humanos.
