La función social de los contratos en los sistemas económicos de mercado

Abstract (en)

The purpose of this paper is to describe the current status in the Brazilian academic writings and case law regarding the social function of contracts (the first part addresses this topic) – identifying the social function of the contract under the view of the distributive character of the “social justice”, which is inherent to the Social State. Second, the paper suggests a critical analysis about the consensus that is arising among Brazilian jurists and judges concerning the social function, starting with a view defended by the school of economic analysis of the Law.

El propósito de este trabajo es describir la situación actual en los escritos académicos brasileños y la jurisprudencia sobre la función social de los contratos (la primera parte aborda este tema) - identificar la función social del contrato bajo la visión del carácter distributivo de la "Justicia social", que es inherente al Estado Social. En segundo lugar, el documento sugiere un análisis crítico sobre el consenso que surge entre juristas y jueces brasileños sobre la función social, partiendo de una visión defendida por la escuela de análisis económico de la Ley.
