Test de proporcionalidad de la Ley de Fomento para la Lectura y el Libro: condiciones empíricas del precio fijo de libros electrónicos y el derecho a la lectura
Proportionality Test of the E-book Law: Empirical Conditions of Fixed E-book Prices and the Right to Read

Abstract (en)
European e-book laws establish fixed pricing as a policy aimed at ensuring accessibility and protecting independent bookstores. In contrast, U. S. courts view the setting of agreed prices between technology platforms and publishers as an antitrust practice. However, there is a lack of studies on e-book pricing laws in Latin American countries.
The reform of Mexico’s Law for the Promotion of Reading and Books, which establishes fixed pricing for e-books, provides a legal framework to assess the objectives of book availability and access, as well as their impact on the right to read. The study applies the Alexy´s model of proportionality test to the legal reform and examines the empirical conditions of the e-book market in Mexico.
The findings reveal that readers pay, on average, 2.39 times more for fixed-price e-books than for those with free pricing. Additionally, fixed-price-e-books tend to have similar prices to their print versions, thus avoiding the competitive pressure to lower prices. The legal reform may lack suitability for achieving its stated goals, and there may be alternative legal measures that would impose a lesser burden on the right to read. As such, the reform constitutes a legally disproportionate measure.
These results may be relevant for other Latin American countries, where international retail platforms and Spanish-language publishers operate, and where fixed-price laws may function as public law regulations that affect the right to read.

Las leyes europeas sobre libros electrónicos establecen la fijación de precios como una política de accesibilidad y protección a las librerías minoristas. En contraste, los tribunales estadounidenses consideran que un acuerdo legal sobre el precio de un libro electrónico entre plataformas tecnológicas y editoriales constituye una práctica antimonopólica. Sin embargo, son escasos los estudios sobre las leyes de precios de libros electrónicos en países latinoamericanos.
La reforma de la Ley de Fomento para la Lectura y el Libro en México, que establece el precio fijo para los libros electrónicos, sirve para ponderar jurídicamente los fines de disponibilidad y acceso al libro, así como su afectación al derecho a la lectura. El estudio aplica el test de proporcionalidad alexiano a dicha reforma legal y analiza las condiciones empíricas del libro electrónico en México.
Los hallazgos revelan que los lectores pagan, en promedio, 2.39 veces más por libros de precio fijo que por libros de precio libre. Además, este tipo de libros electrónicos presentan precios similares a sus versiones físicas, lo que evita las presiones competitivas hacia la baja de precios. Es posible que la reforma legal adolezca de idoneidad para alcanzar los fines establecidos, que existan alternativas legales que afecten en menor medida el derecho a la lectura y que, en consecuencia, esta sea una medida jurídicamente desproporcionada.
Los resultados pueden ser relevantes para otros países de Latinoamérica, donde operan plataformas internacionales de venta minorista y editoriales de lengua española, y donde las leyes de precio fijo pueden constituir normas de derecho público que afecten el derecho a la lectura.

As leis europeias sobre livros eletrônicos estabelecem a fixação de preços como uma política de acessibilidade e proteção às livrarias varejistas. Em contrapartida, os tribunais americanos consideram que um acordo legal sobre o preço de um livro eletrônico entre plataformas tecnológicas e editoras constitui uma prática antimonopolista. No entanto, são escassos os estudos sobre as leis de preços de livros eletrônicos nos países latino-americanos.
A reforma da Lei de Fomento à Leitura e ao Livro no México, que estabelece o preço fixo para os livros eletrônicos, serve para ponderar juridicamente os objetivos de disponibilidade e acesso ao livro, bem como seu impacto no direito à leitura. O estudo aplica o teste de proporcionalidade de Alexiano a essa reforma legal e analisa as condições empíricas do livro eletrônico no México.
As conclusões revelam que os leitores pagam, em média, 2,39 vezes mais por livros com preço fixo do que por livros com preço livre. Além disso, este tipo de livros eletrônicos apresenta preços semelhantes às suas versões físicas, o que evita pressões competitivas para a redução dos preços. É possível que a reforma legal não seja adequada para atingir os objetivos estabelecidos, que existam alternativas legais que afetem menos o direito à leitura e que, consequentemente, esta seja uma medida juridicamente desproporcional.
Os resultados podem ser relevantes para outros países da América Latina, onde operam plataformas internacionais de venda a retalho e editoras de língua espanhola, e onde as leis de preço fixo podem constituir normas de direito público que afetam o direito à leitura.
