Abstract (en)

The maintenance of international peace and security

was based,

from 1948 to 1988, on the use of force by the Secur

ity Council of the United

Nations when there was a military aggression from o

ne country against another.

However, since 1988, the main reasons for the UN mi

litary intervention are the

violations of human rights, not international war.

The article explores the

backgrounds in classical international

doctrine (Vitoria, Grotius, W olff, Vattel and 

Kant) and in the international law of the

XIX and XX centuries (the Eastern

Question, the protection of Christians in the Middl

e East and the end

colonialism).

Resumen. El mantenimiento de la paz y seguridad internacionales se basó, desde 1948 hasta 1988, en el uso de la fuerza por parte del Consejo de Seguridad de la Naciones Unidas cuando sucedían agresiones militares de un Estado contra otro. No obstante, a partir de 1988 el principal motivo para la intervención militar de la ONU son las violaciones a los derechos humanos, no la guerra internacional. El artículo explora los antecedentes en la doctrina internacional clásica (Vitoria, Grocio, Wolff, Vattel y Kant) y en el derecho internacional de los siglos XIX y XX (la Cuestión de Oriente, la protección de los cristianos en el medio oriente y el fin del colonialismo).
